Manufacturers should put legal spare tire

My peeve today is winter tires. Believe me I am in complete favour of them yet my 2012 sedan has (from the factory) a spare wheel that is smaller in diameter than the other wheels and a summer type tread.

Why are they legal? Putting that 鈥渄oughnut鈥� on the front of my car on a slippery winter day makes me an accident looking for a place to happen. Again I ask why are they legal?
